集体经济组织在现实中和立法上都非常混乱，不适宜作为集体土地所有权行使代表。

邓沿用毛泽东主义农村秩序两个基础原则：土地集体所有制和禁止农民流向城市的隔离体系。

土地私有制两千年历史变迁的轨迹和线索，对人们把握当代土地集体所有制的历史方位和运动规律有重要启示。

第一次规定了该权利行使的意思机关，完善了集体土地所有权制度。

目前土地承包经营权没有和集体土地所有权、国有土地使用权等其他土地权利统一登记 ,造成了土地登记不统一。
