摘要对英美法系上的预期违约制度的概念、构成及其救济方式进行了探讨和研究，对我国《合同法》在引进这一制度上的得与失进行了评析，指出我国预期违约制度没有明确建立起默示预期违约制度，并对建立和完善默示预期违约制度提出了建议。
