第四条中华人民共和国境内外的公司、企业、其他组织和个人，除法律另有规定者外，均可按《中华人民共和国城镇国有土地使用权出让和转让暂行条例》、《外商投资开发经营成片土地暂行管理办法》和《上海市土地使用权有偿转让办法》的规定，取得土地使用权。
